Location Information: With your explicit permission, we may collect your precise GPS location to help you set your delivery address easily and to facilitate delivery. You can disable location services at any time through your mobile device settings. Usage Data: Information on how you access and use the App, such as the features you use, the pages you view, the time and date of your visits, and other diagnostic data. Device Information: We may collect information about the mobile device you use, including the hardware model, operating system and version, unique device identifiers, and mobile network information.

2. How We Use Your Information

Apas Marketing uses the collected data for the following specific and lawful purposes:

To Provide and Maintain our Service: To create and manage your account, and enable you to place and receive orders.
To Process and Deliver Your Orders To share your name, address, and phone number with our delivery personnel to ensure timely and accurate delivery of your water bottles.
To Process Payments: To facilitate transactions for the Products you purchase.
To Communicate With You: To send you service-related communications, such as order confirmations, delivery updates, receipts, and security notices.

Welcome to Apas Marketing! These Terms and Conditions ("Terms," "Terms and Conditions") govern your use of the Apas Marketing mobile application (the "App") and the water bottle delivery services (the "Service") provided by Apas Marketing ("us," "we," or "our"). Please read these Terms and Conditions carefully before downloading, registering, or using our App. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Definitions

App:The mobile application named "Apas Marketing" available on various platforms.
User/You:Any individual or entity who downloads, registers, or uses the App and its Services.
Service: The sale and delivery of drinking water bottles and related products as offered on the App.
Products: The drinking water bottles, cans, and any other items available for purchase through the App.
Order: A request placed by a User for the delivery of Products through the App.

2. User Account

Registration:To use our Service, you must create an account. You agree to provide accurate, complete, and current information during the registration process.
Eligibility:You must be at least 18 years of age to create an account and use our Services.
Account Security: You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree to notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
Account Information: It is your responsibility to keep your delivery address and contact information updated in the App. Apas Marketing is not liable for deliveries made to an incorrect address provided by you.

3. Orders, Pricing, and Payment

Placing Orders:By placing an Order through our App, you are making an offer to purchase the selected Products subject to these Terms. All Orders are subject to availability and our acceptance.
Pricing:All prices for Products are listed in Indian Rupees (INR) and are inclusive of applicable taxes (such as GST), unless stated otherwise. We reserve the right to change the prices of Products at any time without prior notice.
Payment:We accept various payment methods, including but not limited to Credit/Debit Cards, UPI, Net Banking, and Cash on Delivery (COD), as available on the App. You agree to provide valid and current payment information. For online payments, we use a third-party payment gateway, and their terms and conditions will apply.
Confirmation:Once an Order is placed and payment is confirmed, you will receive a confirmation via the App, SMS, or email. This confirmation does not signify our final acceptance of your order, but rather confirms that we have received it.

4. Delivery

Delivery Area:Our Services are available only in specific geographical areas within and around Malappuram, Kerala. We reserve the right to restrict delivery to certain locations.
Delivery Time:We will provide an estimated delivery time for your Order. However, these are estimates and may vary due to traffic, weather conditions, or other unforeseen circumstances. We shall not be liable for any reasonable delays in delivery.
Receipt of Delivery:You or a designated person must be available at the delivery address to receive the Order. If we are unable to deliver the Order, we will attempt to contact you. A re-delivery attempt may be subject to an additional fee.
Inspection:Please inspect the Products upon delivery. If you find any damage (e.g., leaks, broken seals), please inform the delivery personnel immediately and contact our customer support.

5. Cancellations, Refunds, and Returns

Cancellation by User:You may cancel an Order through the App before it has been dispatched for delivery. Cancellation policies and any applicable charges will be detailed in the App. Orders cannot be cancelled once they are out for delivery.
Cancellation by Apas Marketing:We reserve the right to cancel any Order for reasons including, but not limited to, non-availability of the product, delivery area being out of our service range, or payment-related issues. In such cases, any amount paid by you will be refunded.
Refunds and Returns:Refunds for cancelled or returned orders will be processed to the original mode of payment within a specified number of working days. Products are non-returnable once delivery has been accepted, except in cases of manufacturing defects or damage reported at the time of delivery. We may require photographic evidence of the issue.

You agree not to use the App or Service for any purpose that is unlawful or prohibited by these Terms. You agree not to:

Interfere with the proper working of the App.
Attempt to gain unauthorized access to our systems or user accounts.

All content, trademarks, logos, and service marks displayed on the App are the property of Apas Marketing or its licensors. To the fullest extent permissible by law, Apas Marketing disclaims all warranties. We do not warrant that the App, its servers, or e-mail sent from us are free of viruses or other harmful components. Our liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to us for the specific Order giving rise to the claim.

You agree to indemnify, defend, and hold harmless Apas Marketing, its directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your use of the Service or your violation of these Terms.

11. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India. You agree that any legal action or proceeding arising out of or relating to these Terms will be brought exclusively in the competent courts of Malappuram, Kerala, India.

12. Changes to Terms and Conditions

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on the App. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
